Abstract: | In the fashion of the reality show, The Amazing Race, after 14 years and 12 Consultation Documents, we now have a new Act to regulate companies in Malaysia, the Companies Act 2016, to replace the Companies Act 1965. The old Act was amended more than 30 times during its lifetime of 50 years. It was time to have a new Act. The new Companies Act 2016 (“the CA 2016”) has reformed almost all aspects of company law in Malaysia and, as I have repeatedly said to my students this past five months, if I were now to give the same set of exam paper for company law drafted prior to January 2017, I would have to prepare a different marking scheme. |
